Trademark Protection Notice

1. Protection of the SENSATIA & SENSATIA BOTANICALS Trademarks

The SENSATIA and SENSATIA BOTANICALS trademarks have been consistently used and developed and have obtained legal protection through trademark registrations in Indonesia and various other countries. Such registrations and protection form part of the Company's ongoing efforts to safeguard its intellectual property rights, brand identity, reputation, and exclusive trademark rights.

All rights associated with the use of the SENSATIA and SENSATIA BOTANICALS trademarks are protected under applicable laws and regulations. Accordingly, any use of these trademarks by third parties must be based on a lawful right, authorization, or consent granted by the trademark owner or rights holder.

2. Recognition of SENSATIA & SENSATIA BOTANICALS as Well-Known Trademarks

In addition to the protection afforded by trademark registrations in Indonesia and various other countries, the SENSATIA and SENSATIA BOTANICALS trademarks have been recognized as Well-Known Trademarks through court decisions in Indonesia.

Under Decision No. 8/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt Pst of the Commercial Court at the Central Jakarta District Court, the Court expressly declared the SENSATIA and SENSATIA BOTANICALS trademarks to be Well-Known Trademarks.

The decision was subsequently upheld on cassation by the Supreme Court of the Republic of Indonesia under Decision No. 1225 K/Pdt.Sus-HKI/2025, which dismissed the cassation appeal against the lower court's decision.

The status of SENSATIA and SENSATIA BOTANICALS as Well-Known Trademarks was further affirmed under Decision No. 10/Pdt.Sus-HKI/Merek/2025/PN Niaga Smg of the Commercial Court at the Semarang District Court, which expressly declared in its operative ruling that the SENSATIA and SENSATIA BOTANICALS trademarks are Well-Known Trademarks.

Accordingly, the protection of the SENSATIA and SENSATIA BOTANICALS trademarks is based not only on their trademark registrations but is also reinforced by judicial recognition of their status as Well-Known Trademarks.

3. Use of the SENSATIA & SENSATIA BOTANICALS Trademarks

The SENSATIA and SENSATIA BOTANICALS trademarks, including their names, logos, labels, visual identities, and other associated trademark elements, constitute an important part of the Company's identity, reputation, and legally protected intellectual property.

Any commercial use of the SENSATIA and/or SENSATIA BOTANICALS trademarks, or any names, logos, signs, or other elements that are identical or substantially similar to these trademarks, must be based on a lawful right, authorization, or consent from the trademark owner or rights holder.

Unauthorized use is prohibited, including any use that may create a false impression of a relationship, affiliation, collaboration, sponsorship, endorsement, approval, or other official association with SENSATIA and SENSATIA BOTANICALS where no such relationship actually exists.

The existence of a commercial relationship with PT SENSATIA BOTANICALS, whether as a distributor, reseller, retailer, vendor, supplier, tenant, or other business partner, does not, in itself, confer any right to use, apply for registration of, or register the SENSATIA and/or SENSATIA BOTANICALS trademarks, unless valid written consent or authorization has been obtained.

4. Notice Regarding Unauthorized Trademark Use

In light of identified instances of unauthorized use of the SENSATIA and/or SENSATIA BOTANICALS names and/or trademarks by third parties without lawful rights or valid consent, all parties engaging in such use are hereby requested to:

1. Immediately cease all unauthorized use of the SENSATIA and/or SENSATIA BOTANICALS trademarks, including any names, logos, signs, or other identifying elements that are identical or substantially similar to those trademarks;
2. Cease the production, promotion, distribution, offering for sale, and/or sale of any goods or services bearing the trademarks without authorization;
3. Withdraw from circulation any products and/or commercial materials bearing the trademarks without authorization;
4. Remove all unauthorized uses of the trademarks from products, packaging, labels, signage, promotional materials, websites, online marketplaces, social media, business names, domain names, digital materials, advertisements, and any other commercial media; and
5. Refrain from any further use of the trademarks unless and until lawful rights, authorization, or valid written consent have been obtained from the trademark owner or rights holder.

This notice also applies to the use of any names, signs, logos, visual appearances, or other identifying elements that, although not entirely identical, are substantially similar to the SENSATIA and/or SENSATIA BOTANICALS trademarks, including any use that may cause confusion or create a misleading impression of a relationship or affiliation with PT SENSATIA BOTANICALS.

5. Protection of Rights and Legal Remedies

PT SENSATIA BOTANICALS prioritizes amicable resolution by providing the relevant parties with an opportunity to voluntarily cease any unauthorized use of the trademarks.

Nevertheless, should such unauthorized use continue, the trademark owner or rights holder and PT SENSATIA BOTANICALS reserve all rights and legal remedies available under applicable laws and regulations to protect their trademarks, reputation, and legitimate interests.

Depending on the nature and circumstances of the infringement, such remedies may include demands for the cessation of unauthorized trademark use, withdrawal and/or removal of products or materials bearing the trademarks without authorization, objections to or cancellation of trademark registrations, civil proceedings, claims for damages, and/or any other legal remedies available under applicable laws and regulations.

PT SENSATIA BOTANICALS will take such action as may be necessary against any unauthorized use that may infringe upon or prejudice the rights and interests associated with the SENSATIA and SENSATIA BOTANICALS trademarks.

6. Information for Consumers, Business Partners, and the General Public

This notice is also addressed to consumers, business partners, distributors, resellers, retailers, online marketplaces, digital platforms, media organizations, and the general public as part of the Company's efforts to safeguard product authenticity and trademark integrity, and to prevent confusion regarding the origin of products or any party's relationship with PT SENSATIA BOTANICALS.
